Cycle Toronto granted injunction to save bike lanes

On April 23rd, we were granted an injunction that will ensure that the bike lanes on Bloor, Yonge, and University will remain in place until the judge presiding over our Charter challenge makes his decision:

“Having regard to all the evidence and submissions now before the Court, and which was not before Firestone RSJ, I conclude that the balance of inconvenience favours the applicants.... Accordingly, I grant an injunction suspending the operation of the Target Bike Lane Removal Provision until the release of my decision on the application.”

-Justice Schabas

The decision comes after our hearing on April 16th, where our lawyers from Paliare Roland and Ecojustice argued that an injunction was necessary so that the province couldn’t act on its plans to remove bike lanes in the interim.

The facts are clear: ripping out bike lanes won’t solve congestion and will put people’s lives at risk. Yesterday’s decision should give even more clarity to the province to reconsider this reckless and arbitrary legislation, and instead work with municipalities on evidence-based solutions to keep all Torontoians moving.
